WA Bill to Protect Community from Mining by Expanding Minister’s Discretion

Mining (Community Protection) Amendment Bill 2015 (WA)

The Bill seeks to amend the Mining Act 1978 (WA) to provide for greater ministerial protections of communities vulnerable to mining exploration and licencing. Determination of an application for a mining tenement will be subject to planning schemes under the Planning and Development Act 2005 (WA). This Bill seeks to extend the discretion of the Minister for Mines and Petroleum, expanding the minister’s exemption capacity to private land as well as public land, as well as ensure any mining application operates pursuant to local and regional planning schemes. This Bill is currently before the Legislative Council.
