The South Australian Government has introduced the National Gas (South Australia) (Pipelines Access—Arbitration) Amendment Bill 2017 (SA). The Bill would have the effect of amending the National Gas (South Australia) Act 2008 (SA) by inserting Chapter 6A which would regulate access disputes over non-scheme pipelines. The Act, under Chap 1, Pt 1, s 2, defines a scheme pipeline as either (a) a covered pipeline; or (b) an international pipeline to which a price regulation exemption applies. Chapter 6A would introduce a legislative scheme of dispute resolution over non-scheme pipelines from negotiation to arbitration to enforcement. The Bill is yet to be debated.
