A dispute over the inclusion of Wilmar Sugar in the leadership team of Queensland Sugar Limited has been the cause of legal action with Wilmar saying that it had intentionally been excluded from being able to appoint a director to the board of Queensland Sugar Limited. Late last year, a challenge by Wilmar to the Federal Court was dismissed although this decision was reversed on appeal last week with the resolution that amended the Constitution of Queensland Sugar Limited found to be ‘oppressive to, unfairly prejudicial to, or unfairly discriminatory against’ Wilmar. The companies will now engage in out-of-court dispute resolution to resolve governance issues after Queensland Sugar Limited dismissed the Board last week.
