The Wollar Progress Association public interest case is bringing a public interest case against Wilpinjong Coal seeking to declare that their approval to expand their mine was invalidly given. The applicant claims that the approval given by the Planning and Assessment Commission (PAC) did not adequately consider the climate change implications of the proposed expansion. In New South Wales, greenhouse gas emissions resulting from mining are required to be considered by the decision-maker as per the State Environmental Planning Policy and the NSW Climate Change Policy Framework 2016. In the alternative, the applicant will claim the PAC was invalidly constituted and that endangered biodiversity was not considered correctly.
