NSW Planning Amendments Considered

This Government Bill will introduce independent planning panels to assess developments, removing this role that has previously been performed by local councils. Independent Hearing and Assessment Panels will only be required within the Greater Sydney and Wollongong Regions.  The Bill is awaiting assent.

  • Environmental Planning and Assessment Amendment (Addressing Climate Change) Bill 2017

The Private Member’s Bill has been introduced to the Legislative Council that would compel decision-makers to consider climate change under environmental planning instruments and when considering approvals for development. Currently, there is an absence of climate change mentioned in the Environmental Planning and Assessment Act 1979 (NSW) which means decision-makers do not have to consider the impact a development may have on the climate. Recent case law has found climate change is an increasingly necessary consideration for specific developments, however there remains no general statutory obligation.
