The COAG Energy Council has reformed the pathway for decision review of the Australia Energy Regulator through the Limited Merits Review Process. This appeals process is a cost that has been passed on to consumers in energy bills and has contributed to rising costs in energy supply. The Limited Merits Review Process allowed decisions made by the Australian Energy Regulator to be reviewed by the Australian Competition Tribunal. Following the publication of the Review of Limited Merits Review Regime: Consultation Paper the COAG Energy Council decided not the abolish the process but reform it by reducing the opportunity for hearing through limiting grounds for review, placing more onus on suppliers to demonstrate the need for review, and providing for greater involvement of consumers in review. The reforms are currently being designed by a working group.
