Warkworth Mine Fined for Breach of Licence

  • Environment Protection Authority v Warkworth Mining Limited [2017] NSWLEC 107 (25 August 2017)

Last week the New South Wales Land and Environment Court found Warkworth Mining Ltd guilty under s 64 of the Protection of the Environment Operations Act 1997 (NSW) for being in breach of a condition of their licence and issued a $50 000 fine and an adverse costs order. Warkworth Mining Ltd undertook earthworks at the Warkworth Mine in 2016 but did not adequately monitor the quality of the work. Consequently, the new embankment wall collapsed completely when water levels reached the heightened embankment which led to up to 4 ML of sediment laden water escaping from the dam.
