People for the Plains Incorporated v Santos NSW (Eastern) Pty Ltd [2017] NSWCA 46 (14 March 2017)
The applicant appealed the decision from the Land and Environment Court of NSW that permitted the respondent to manage wastewater consequent to their operations. The respondent holds a licence and two leases in relation to onshore petroleum exploration and production. As a consequence of this petroleum project lease, the respondent intended to use the Leewood Produced Water Treatment and Beneficial Reuse Project to manage wastewater. Although this Project was located on the site of the lease, the applicant’s argument turned on the need for the respondent to receive further approvals, including development consent to complete the Project. The judicial review and proceedings seeking a declaration over the Project were both rejected at first instance. This decision was upheld in the Court of Appeal.
