NSW Environment Legislation Update

The NSW Government has released draft regulations and associated subsidiary legislation to support the recent Biodiversity Conservation Act 2016 (NSW) and the Local Land Services Amendment Act 2016 (NSW). The documents are currently on public exhibition.

The NSW Government has introduced the Protection of the Environment Legislation Miscellaneous Amendments Bill 2017 (NSW) into parliament last week. The Bill will largely work to increase efficiencies across the state’s environmental laws. Key amendments include, ensuring the Environment Protection Authority has a consistent set of investigatory powers and changing licences for trackable waste from perpetual licence requirements to five-year terms. Amendments will also increase the timeframe under which EPA can investigate groundwater offences.

The Bill will amend:

  • the Contaminated Land Management Act 1997;
  • the Protection of the Environment Operations Act 1997;
  • the Protection of the Environment Administration Act 1991; and
  • the Radiation Control Act 1990.

The Bill remains before the Legislative Assembly.
