John Holland Pty Ltd v Adani Abbot Point Terminal Pty Ltd  QSC 292 (12 December 2016)
In 2009 the applicant entered contracts with a third party with the intention to provide construction services for the Abbot Point Coal Terminal. The interests of that third party was later passed to the respondent. This application for leave arose out of a commercial arbitration agreement between the parties that the applicant contested was made in error of law by stating the contracts between the applicant and the third party had been repudiated. The application was dismissed on all grounds, with the original decision made by the arbitration tribunal upheld.
